1. Scope
1.1 These General Terms and Conditions (hereinafter referred to as “GTC”) govern the use of the portal maxnext.io, provided by maxnext GmbH, Fliederstraße 8, 91126 Rednitzhembach (hereinafter referred to as the “Provider”). 

1.2 By registering an account on maxnext.io and using its services, the user declares that they have read, understood, and accepted these GTC.

2. Registration and User Account 
2.1 To use maxnext.io, the creation of a user account is required. The user agrees to provide truthful, complete, and up-to-date information during registration. Any changes must be updated promptly. 

2.2 The user is responsible for the security of their account and agrees to keep their login credentials confidential. The Provider is not liable for damages resulting from unauthorized use of the account. 

2.3 The Provider reserves the right to reject registrations or block user accounts if there is suspicion of misuse.

3. Services Provided by the Provider
3.1 The Provider enables users to upload, store, and manage 3D data via the portal. 

3.2 The availability of the portal may be temporarily restricted for technical or operational reasons. The Provider strives to ensure uninterrupted use but does not guarantee uninterrupted availability.

4. Uploading and Use of 3D Data
4.1 The user guarantees that they hold all necessary rights to the uploaded 3D data and that its use does not infringe on third-party rights (e.g., copyrights, personal rights). 

4.2 By uploading data, the user grants the Provider a non-exclusive, unlimited, and worldwide right to store, display, and process the data within the scope of the offered services. 

4.3 The user retains ownership of the uploaded data. The Provider does not acquire ownership rights to the data.

5. Data Protection and Security
5.1 The Provider processes users’ personal data in accordance with applicable data protection laws, particularly the GDPR. Further details can be found in the [Privacy Policy](Link to Privacy Policy). 

5.2 The Provider implements appropriate technical and organizational measures to ensure the security of stored data. However, the Provider assumes no liability for damages caused by unauthorized third-party access.

6. Prohibited Uses 
6.1 It is prohibited to upload unlawful, offensive, discriminatory, pornographic, or otherwise inadmissible content via maxnext.io. 

6.2 Violations of these GTC or applicable law may result in the immediate suspension of the account and deletion of the respective data. The Provider reserves the right to take legal action.

7. Liability
7.1 The Provider is liable only for damages caused by intent or gross negligence. In cases of ordinary negligence, the Provider is only liable for the breach of essential contractual obligations (cardinal obligations), and liability is limited to foreseeable and typical damages. 

7.2 The Provider is not liable for loss or damage to uploaded data unless caused by gross negligence on the part of the Provider.

8. Changes to the GTC 
8.1 The Provider reserves the right to change these GTC at any time. Users will be informed of changes in a timely manner. 

8.2 Changes are deemed accepted if the user does not object within 30 days. In the event of an objection, the Provider has the right to terminate the contractual relationship.

9. Final Provisions 
9.1 Should individual provisions of these GTC be invalid, the validity of the remaining provisions remains unaffected. 

9.2 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. 

9.3 The place of jurisdiction, as far as legally permissible, is the registered office of maxnext GmbH.
